Board of Health Grants 48-Foot Pool Fence Variance

Orleans Board of Health approves a 48-foot pool fence variance, defers a second, more contested one. Members voted 3-0, with Chairman Joseph Hartung recused, to let 63 Kescayogansett Road builder Eastward Companies, represented by Susan Ladue, install a pool fence up to 68 feet from the pool apron, backed by an automatic cover and alarmed gates and doors. A separate variance request at 65 Towhee Lane, opposed by abutter Jeanette Kunow, who said "There are eight other pools, they all have fences, they all follow those rules," was continued to September 17 after the board split over whether a pool cover can substitute for a fence; builder Don Bliss warned a denial would likely be litigated.
The board also continued a sewer-connection show cause hearing for 8 Old Tote Road to October 15, approved licenses for two septic installers and a retroactive food permit for Perry's Ice Cream Truck, and heard that West Nile virus risk in Orleans has risen to moderate.
